Advertising & Promotions Policy

1. Introduction

This Advertising & Promotions Policy (“Policy”) explains the rules, terms, and standards governing all advertisements, sponsored listings, boosts, and promotional content (“Ads”) placed on the TellTap Uganda Limited (“TellTap”) platform.

The purpose of this Policy is to:

  • Ensure fairness and transparency
  • Protect the integrity of user reviews
  • Comply with Ugandan advertising standards and laws
  • Promote ethical and responsible advertising

This Policy applies to all businesses purchasing or using paid features on TellTap.

2. Definitions

  • “Advertiser” – A business that purchases or uses advertising features.
  • “Ads / Promotions” – Paid listings, boosted visibility, banners, coupons, and promotional features.
  • “Sponsored Listing” – A business ad that appears in priority placements.
  • “Boost” – Temporary enhanced visibility in search results or categories.
  • “Organic Content” – Free listings, public reviews, and unsolicited customer feedback.
  • “Platform” – The TellTap website, mobile app, and business dashboard.

3. Core Principles

TellTap advertising is founded upon three principles:

  • Honesty: Paid advertising does not influence:
    • Review ranking
    • Visibility of negative reviews
    • Star ratings
    • Recommendation algorithms
  • Transparency: Sponsored content is clearly marked as:
    • “Sponsored”
    • “Ad”
    • “Promoted”
  • Equality: All businesses—advertisers and non-advertisers—are treated equally in review moderation and display.

4. Types of Advertising Offered

4.1 Sponsored Listings

Appear at the top of:

  • Search results
  • Category pages
  • Business directories

4.2 Boosted Visibility

Limited-time increased exposure in:

  • Local search
  • Popular categories
  • Recommended businesses

4.3 Display Ads

Image or banner-style ads appearing on:

  • Home page
  • Explore page
  • Category pages

4.4 Promotional Offers

Businesses may promote:

  • Discounts
  • Coupons
  • Sales
  • Event-based promotions

4.5 Enhanced Business Profile Features

Optional add-ons include:

  • Call-to-action buttons
  • Highlighted menus
  • Portfolio photos
  • Custom banners

5. What Advertising Cannot Do

Advertising cannot:

  • Remove negative reviews
  • Influence review order
  • Hide or bury organic content
  • Guarantee a rating increase
  • Ensure top ranking without the “Sponsored” label
  • Block competitor listings
  • Override TellTap’s review recommendation algorithm

TellTap remains neutral in:

  • Review moderation
  • Star rating calculations
  • Review recommendations

6. Advertiser Responsibilities

Advertisers must:

6.1 Provide Truthful and Accurate Information

No false claims, misleading descriptions, or fake promotions.

6.2 Maintain Up-to-Date Business Information

  • Phone numbers
  • Addresses
  • Operating hours
  • Pricing

6.3 Comply with Ugandan Laws

  • Consumer Protection Guidelines (UCC)
  • The Competition Act
  • The Data Protection and Privacy Act
  • Sector-specific regulations (foods, health, finance, etc.)

6.4 Respect User Privacy

You may not harvest, store, or use TellTap user data without explicit consent.

7. Prohibited Advertising Content

Ads must not contain:

  • Illegal or harmful content:
    • Drugs, illegal medications, or controlled substances
    • Weapons, explosives, armaments
    • Human trafficking or exploitation
  • Misleading content:
    • Fake prices
    • False discounts
    • Unverifiable claims
  • Discriminatory content:
    • Hate speech
    • Tribalism
    • Sexism
    • Religious discrimination
  • Adult or explicit content:
    • Pornography
    • Sexually suggestive material
    • Adult entertainment services
  • Offensive content:
    • Violence
    • Graphic images
    • Profane language
  • Fraudulent financial schemes:
    • Ponzi schemes
    • Unlicensed investment programs

TellTap reserves the right to reject or remove any advertisement at its discretion.

8. Payment Terms

8.1 Pricing

Prices for advertising and boosts are provided in the advertising dashboard or via direct contract.

8.2 Payment Methods

  • Mobile money (MTN, Airtel)
  • Bank transfer
  • Visa/MasterCard
  • Corporate invoicing

8.3 Refunds

  • Ads already delivered are non-refundable
  • Ads rejected for violating this Policy may be refunded at TellTap’s discretion

8.4 Late Payments

  • Ad suspension
  • Account restriction
  • Penalties where applicable

9. Transparency and Disclosures

All paid content is clearly labeled. Users will always know whether a business is sponsored, a listing is promoted, or a placement is organic. TellTap never hides these disclosures.

10. Data and Analytics

Advertisers may receive:

  • Traffic data
  • Engagement statistics
  • Ad performance insights
  • Category trends

TellTap does not share individual user identities or private data unless voluntarily provided.

11. Advertising Review Process

TellTap may review ads for:

  • Accuracy
  • Compliance
  • Safety
  • Ethical standards

Ads violating this Policy may be removed, rejected, restricted, or reported to authorities.

12. Suspension and Termination

TellTap may suspend or terminate advertising privileges if:

  • Violates Ugandan law
  • Ads are fraudulent or misleading
  • Payments fail
  • Advertiser manipulates reviews
  • Engages in discriminatory or abusive behavior

Suspension may affect campaigns, business features, and access to analytics.

13. Limitation of Liability

TellTap is not responsible for:

  • Sales decreases
  • Customer dissatisfaction
  • Poor campaign performance
  • Business reputation issues
  • Technical interruptions

Maximum liability is limited to the amount paid by the advertiser for the affected advertising period.

14. Dispute Resolution

  1. Negotiation – 7 Days: Attempt to resolve directly with TellTap.
  2. Mediation: Handled under the Judicature (Mediation) Rules.
  3. Arbitration: Handled per the Arbitration and Conciliation Act, Cap. 4. Venue: Kampala. Decision: Final.
  4. Ugandan Courts: For enforcement or unresolved matters.

15. Governing Law

This Policy is governed exclusively by the laws of the Republic of Uganda, including:

  • The Contracts Act, 2010
  • The Data Protection and Privacy Act, 2019
  • The Competition Act
  • Uganda Communications Commission Guidelines
